Terms of Service

Last updated: 25 August 2026

These terms govern use of PosturalPal, a clinical postural-assessment platform provided to health professionals. By creating an account or using the service you agree to them.

1. The service

PosturalPal provides software for capturing postural photographs, computing postural measurements, tracking patients over time and prescribing exercises. We grant your clinic a non-exclusive, non-transferable licence to use the service for its internal clinical practice while your subscription is active.

2. Clinical responsibility — important

PosturalPal is a measurement and documentation tool. It is not a medical device, it does not diagnose, and it does not replace professional judgement. All clinical decisions — assessment, diagnosis, treatment and exercise prescription — remain solely the responsibility of the treating practitioner. Measurements are derived from photographs and detected landmarks and should be verified by the clinician before being relied on.

3. Accounts

You must provide accurate information, keep credentials confidential, and be a registered or qualified health professional (or staff acting under one) to hold a clinician account. You are responsible for activity under your account. Notify us promptly of suspected unauthorised use.

4. Patient data & consent

As between you and us, your clinic owns the patient records it enters. You warrant that you have obtained each patient’s informed consent to capture photographs and record their information in the service, and that your use complies with your professional and privacy obligations. We process patient data only to provide the service, as described in the Privacy Policy.

5. Acceptable use

You must not: use the service for anything unlawful; upload content that infringes others’ rights; attempt to breach, probe or overload our systems; resell or provide the service to third parties; or reverse-engineer the software except as law permits.

6. Subscriptions & payment

Paid plans are billed in advance in Australian dollars (GST inclusive) monthly or annually. Trials are free for 30 days and do not convert automatically to a paid plan. You may cancel at any time; the subscription ends at the close of the current billing period and fees already paid are not refunded except as required by law (including the Australian Consumer Law).

7. Availability & changes

We aim for high availability but the service is provided “as is” and may be interrupted for maintenance or by events outside our control. We may improve or change features; if a change materially reduces the service, you may cancel and receive a pro-rata refund of prepaid fees.

8. Data export & termination

You can export your clinic’s records at any time while your account is active. We may suspend or terminate accounts that breach these terms. On closure, data is handled as described in the Privacy Policy.

9. Liability

Nothing in these terms excludes rights that cannot be excluded under the Australian Consumer Law. Otherwise, to the maximum extent permitted by law: we are not liable for indirect or consequential loss, and our total liability arising out of the service is limited to the amount you paid us in the 12 months before the claim. You remain solely liable for clinical outcomes and for your obligations to your patients.

10. Governing law

These terms are governed by the laws of Western Australia, Australia, and the parties submit to the jurisdiction of its courts.
